Terms of Service

⚠️ Not Legal Advice This document is a working template. GigEdge has not yet obtained formal legal review. These terms are enforceable to the extent permitted by law but should be reviewed by a licensed attorney before public launch.

1. Acceptance of Terms

By downloading, installing, or using GigEdge ("App", "Service"), you ("User", "you") agree to be bound by these Terms of Service ("Terms"). If you do not agree, do not use GigEdge.

GigEdge is operated by Kenneth Hunter ("Company", "we", "us"). These Terms govern your use of the GigEdge web app, iOS app, and any related services.

2. Description of Service

GigEdge is a gig-economy optimization tool designed to help independent gig workers make smarter offer decisions, track earnings, automatically log mileage for tax records, and identify high-value zones. Features include offer analysis, zone heat maps, earnings analytics, screenshot parsing, voice input, automatic mileage tracking, and IRS-compliant tax report exports.

GigEdge supports drivers working across DoorDash, Uber Eats, Grubhub, Instacart, Walmart Spark, Uber, Lyft, and other gig platforms. We are not affiliated with any of these companies.

3. Account Registration & Authentication

Access to GigEdge requires a verified email address. We use one-time passwords (OTP) sent via email to authenticate users. You are responsible for keeping your credentials secure.

30-Day Idle Re-Authentication

For your security, any device that has not been active for 30 or more consecutive days will have its session automatically cleared. You will be required to re-verify your email via OTP before regaining access.

Active Shift Locking

GigEdge allows only one device to hold an "active shift" at a time. If you attempt to use two devices simultaneously, the second device's shift claim will be rejected unless the first device's session has been inactive for more than 5 minutes.

4. Acceptable Use & Prohibited Conduct

You agree to use GigEdge only for lawful purposes. The following are strictly prohibited:

5. Screenshot Uploads & Data Contribution

When you upload a delivery offer screenshot, you grant GigEdge a non-exclusive, royalty-free license to process and analyze that image using automated AI systems (including third-party AI providers) for the purpose of extracting offer metrics (store name, payout, estimated distance).

Customer Privacy: GigEdge's systems are specifically designed NOT to extract or store customer names, delivery addresses, or any personally identifiable information about customers. Only offer-level data is retained.

Extracted offer data (anonymized) may be used to improve GigEdge's zone intelligence features, which benefit all users by improving zone heat maps and payout estimates. You acknowledge and consent to this use.

6. Fraud Detection & Account Suspension

Automated Fraud Scoring

GigEdge employs server-side automated systems that analyze uploaded screenshots for authenticity signals including: upload velocity, GPS activity correlation, timestamp consistency, cross-device image hash matching, and payout plausibility.

Automatic Suspension

GigEdge may automatically suspend or ban any account that accumulates 5+ uploads scoring 70+ on the fraud scale, accumulates a cumulative fraud score of 300+, or is detected attempting to evade a previous ban via device fingerprint matching.

GigEdge reserves the right to suspend or terminate any account at its sole discretion.

7. Device Tracking & Multi-Device Accounts

GigEdge links your account to the devices you log in on using device identifiers and browser fingerprints. Device records are retained indefinitely for platform security and fraud forensics, even after account deletion.

8. Subscriptions & Payments

GigEdge offers paid subscription plans through Stripe:

Subscriptions auto-renew unless cancelled. You may cancel at any time via your Stripe customer portal (accessible from the Account tab within the app, under "Manage Subscription"). Cancellation takes effect at the end of the current billing period — you retain access until then.

Refunds are not guaranteed but may be issued at GigEdge's sole discretion for documented technical failures within 7 days of charge. Refund requests must be submitted to support@gigedge.app with a description of the issue.

Certain features (Zone intelligence, Voice input, 22-factor Pro Score, Pro Secrets) are restricted to active subscribers. GigEdge reserves the right to change which features require a subscription at any time with reasonable notice.

9. Founder Program

The Founder Program rewards early contributors with subscription discounts based on cumulative delivery contributions. Founder progress is tracked by authenticated email and aggregated across all devices linked to that email. GigEdge reserves the right to modify Founder tier thresholds, rewards, or program terms with 30 days' notice.

10. Intellectual Property

GigEdge and all associated software, design, zone data, and algorithms are the intellectual property of Kenneth Hunter. "GigEdge" is a registered trademark (USPTO applications Classes 009 and 042). The 22-factor offer scoring engine, self-learning traffic patterns dataset, and zone intelligence aggregation methods are proprietary trade secrets of Kenneth Hunter.

11. Third-Party Trademarks & Disclaimers

GigEdge is provided "as is" without warranties of any kind. Zone heat scores and earnings estimates are based on aggregated driver data and are not guarantees of future earnings.

GigEdge is not affiliated with, endorsed by, sponsored by, or connected to DoorDash, Inc., Uber Eats, Grubhub, Instacart, Walmart Spark, Lyft, Uber Technologies, or any other delivery, grocery, retail, or rideshare platform. All third-party platform names, logos, and trademarks referenced in the App are the property of their respective owners. Such references are used solely for nominative fair use to describe the third-party services our users work with.

To the maximum extent permitted by law, GigEdge's total liability for any claims arising from your use of the Service shall not exceed the amount you paid GigEdge in the 3 months preceding the claim.

12. Governing Law & Dispute Resolution

These Terms are governed by the laws of the State of California. Any dispute shall be resolved through binding arbitration in Los Angeles County, California, under the AAA Consumer Arbitration Rules. Class action waiver: you waive any right to participate in a class action lawsuit or class-wide arbitration against GigEdge.

13. Changes to These Terms

GigEdge may update these Terms at any time. Material changes will be communicated via the email address on file. Continued use of the Service after the effective date of changes constitutes acceptance.
